TOPSHELF LIQUOR ONLINE – TERMS & CONDITIONS
Access to and use of TopShelf’s online shopping is subject to TopShelf’s terms and conditions and these terms of use. By purchasing products using TopShelf’s online shopping (Products), you are deemed to have accepted TopShelf’s terms and conditions and terms of use.
GENERAL
Age Restriction
It is illegal to sell liquor to anyone under the age of 18, buy liquor when under the age of 18 and to make a false declaration of age in order to purchase liquor. It is also illegal to purchase alcohol as a gift for anyone under the age of 18 years.
You warrant to TopShelf that, at the time of accessing TopShelf shopping online, you are 18 years or over. TopShelf may request documentation from you verifying your age. If you refuse TopShelf’s request or TopShelf is otherwise unable to verify that you are 18 years or over, TopShelf may cancel your order. If TopShelf cancels your order, TopShelf will not be liable to you for any reason.
Guarantee
TopShelf guarantees quality products and service. If, for any reason, you are dissatisfied with your order, please contact us within 7 days of receipt of your order for customer care assistance by e-mail at office@topshelfliquor.co.nz or phone 09 479 3627.
Refusal, Suspension or Termination
TopShelf reserves the right to refuse registration of a potential customer on the basis of age or for any other reason. TopShelf may also suspend or terminate any order for Products made by any person for any reason.
Shortages or Breakages
Any shortages or breakages must be reported to TopShelf within 24 hours of delivery, preferably by e-mail. Please ensure to quote your receipt number at the time of reporting.
Insurance
The Products are insured by TopShelf up until the actual time of delivery (being on receipt by the Courier of a signature or completion of delivery in accordance with any special instructions).
PRODUCT RANGE/AVAILABILITY
TopShelf will ensure every effort is made to fulfil any order, but you acknowledge that TopShelf will not be liable to you if TopShelf is unable to fulfil or rejects any order for any reason. Product specials are subject to stock availability.
SECURITY AND PRICING
Security
TopShelf will use its reasonable endeavours to prevent any unauthorised access to this site. TopShelf will not be liable to you for any damage, loss or costs incurred by you resulting from any person gaining unauthorised access.
TopShelf online shopping uses encryption protocol to encrypt and thus keep secure all personal data transmitted to and from this site (for example, credit card details). Once TopShelf online shopping receives your personal data, it stores that data on a secure server so that it can not be accessed by any person. TopShelf uses "Payment Express” to securely authorise credit card payments in real time and before any changes are made. Pricing
The prices for Products will be the prices stated on this site at the time you submit your order. No upward or downward price adjustment will apply during the period from the time at which the order is submitted to completion of delivery of that order. Please note that the prices stated on this site may differ from the prices displayed in store.
Product prices may vary from time to time without notice and at TopShelf’s absolute discretion.
To avoid doubt, all prices are stated in New Zealand currency and inclusive of GST and any other applicable sales tax.
Payment Terms
You must pay for Products by credit card, Internet Bank Deposit, or cheque. TopShelf online shopping will not accept any other method of payment. TopShelf may change the payment method at any time and for any reason.
Once payment of your order is processed and accepted by TopShelf online shopping, TopShelf will email you a GST receipt.
TopShelf will generate a packing slip which will accompany your order on delivery.
DELIVERY
Deadlines and Charges
All deliveries within New Zealand will be by Courier and direct to your door (except in some rural situations). The Courier will require a signature upon delivery. If no one is home, the Courier will leave a card requesting that you contact the Courier office either to arrange a suitable delivery time or a suitable time for you to collect the Products from the Courier office.
Special Delivery Instructions
If you give special instructions for delivery, the Courier will deliver your Products in accordance with those instructions. Please add your special instructions in the field provided in this site when confirming your delivery address. It is important to note that, in giving special instructions, you are giving the courier permission to leave your Products without a signature. Accordingly, the Products become entirely your responsibility in the case of loss/theft/damage or otherwise.
Right to Withhold Delivery
TopShelf reserves the right to withhold delivery of any order for such time and for any reason as TopShelf may determine. To avoid doubt, you will have no obligation to pay for any order withheld by TopShelf until such time delivery of that order is completed.
Receipt of TopShelf Products
TopShelf is entitled to assume that any person accepting delivery of the Products is authorised to do so by you.
Delays to Delivery
TopShelf (or any employee, contractor or agent of TopShelf) will not be liable to you or any person for failing to deliver on a timely basis, whether the delay has been due to causes beyond the reasonable control of TopShelf or otherwise.
Change of Address
You must notify TopShelf by email (office@topshelfliquor.co.nz) immediately of any change to your delivery address.
REFUND POLICY
Damaged Product
If any Product is delivered to you in a damaged or spoiled condition, TopShelf may (subject to TopShelf’s agreement that such damage was caused by an act or omission by TopShelf or the Courier) refund you the value of that Product determined as at the date of your relevant order or re-deliver that product.
Undelivered Product
If TopShelf fails to deliver any Product ordered and paid for by you (Relevant Product), TopShelf may, at your request, either:
a) subject to stock availability, deliver (at TopShelf’s earliest opportunity) the Relevant Product to you at no extra cost; or
b) cancel your order for the Relevant Product and refund the actual amount paid for the Relevant Product (determined as at the date of the relevant order).
